Terms of Service

1. Acceptance of Terms

By accessing and using DVM Nexuss, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily use DVM Nexuss for personal or commercial use. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display
• Attempt to decompile or reverse engineer any software
• Remove any copyright or other proprietary notations
• Transfer the materials to another person or mirror the materials on any other server

3. Acceptable Use

You agree to use DVM Nexuss only for lawful purposes and in accordance with these Terms. You may not use the service to: transmit malicious code, violate any applicable laws, infringe on third-party rights, interfere with or disrupt the service or its infrastructure, or use the service for any fraudulent or abusive purpose. We reserve the right to suspend or terminate accounts that violate acceptable use.

4. Intellectual Property

All content, features, and functionality of DVM Nexuss, including but not limited to software, text, graphics, logos, and design, are owned by DvM IoT Solutions or its licensors and are protected by intellectual property laws. You do not acquire any ownership rights by using the service. You may not use our trademarks or branding without prior written consent.

5. User Accounts

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account or password.

6. Payment Terms

Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. You are responsible for paying all applicable taxes.

7. Indemnification

You agree to indemnify, defend, and hold harmless DvM IoT Solutions, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the service, your violation of these Terms, or your violation of any third-party rights.

8. Termination and Data Export

We may terminate or suspend your account at any time for breach of these Terms or for any other reason. Upon termination, your right to use the service ceases immediately. You may request an export of your data prior to termination. We will provide data in a standard format within a reasonable period, subject to applicable data retention policies.

9. Service Availability

We strive to maintain service availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the service at any time with or without notice.

10. Limitation of Liability

In no event shall DVM Nexuss or its suppliers be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use or inability to use the service, even if we or our authorized representative have been notified of the possibility of such damage. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which DvM IoT Solutions is incorporated, without regard to conflict of law principles. Any disputes arising from these Terms or the service shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, disputes may be submitted to the exclusive jurisdiction of the courts in that jurisdiction.
